0. About this Agreement

This User Agreement ("Agreement") is the single document that governs your use of Homvi (the "Service"). It combines what would traditionally be split across separate Terms of Service, Privacy Policy, and disclaimer documents, so you can read everything that applies to you in one place.

By creating an account, signing in, or otherwise using the Service, you agree to this Agreement. If you do not agree, do not use the Service.

In this Agreement, "we," "us," and "our" refer to Homvi LLC, a Colorado limited liability company. "You" and "your" refer to the person using the Service.

1. What the Service does

Homvi helps you create a digital inventory of items in your home, your vehicles, and other personal property. The Service uses AI-assisted photo recognition to identify items, estimate replacement values, and produce structured records you can use for personal record-keeping, insurance claim preparation, estate planning, beneficiary documentation, and similar purposes.

The Service is a record-keeping and documentation tool. It is not an insurance product, a financial product, a legal product, or a substitute for professional advice in any of those areas. See sections 5, 6, and 7 below.

2. Your account

You create an account by signing in with a supported authentication provider (currently Google, via Clerk). You are responsible for keeping your account credentials secure and for any activity that happens under your account.

You may delete your account at any time using the in-app deletion feature (Account → Delete Account). Deletion is immediate and permanent — see section 11 (Data retention and deletion) for what happens to your data.

We may suspend or terminate accounts that violate this Agreement or applicable law. Where reasonable, we will provide notice and an opportunity to correct the violation before terminating, except where prompt action is required to protect users or third parties.

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

3. Your data, your control

You own the data you put into the Service — your photos, item descriptions, addresses, notes, policy documents, and any other content you upload or enter. We do not claim ownership of your inventory or any of the underlying data.

You grant us a limited, non-exclusive license to host, process, display, and transmit your data only as needed to operate the Service for you — for example, storing photos so they appear when you log in, sending them to our AI vendor to identify items you photographed, generating PDFs from your data, and showing your inventory to people you explicitly share a home with. This license ends when you delete the data or close your account.

We do not sell your data. We do not use your data to train AI models of our own. We do not share your data with insurance carriers, realtors, financial advisors, or other third parties except as described in section 9 (Vendors and sub-processors) or with your explicit, scoped, revocable consent.

At any time you can:

  • Download all your data as a JSON export including item details, photos, and policy documents (Account → Data Export).
  • Delete your account and have all data wiped (Account → Delete Account).
  • Edit or remove individual items from within the app.

This is consistent with our operating principle that the property owner — not us, not a carrier, not a partner channel — controls the data.

4. AI accuracy

The Service uses AI vision models to identify items in your photos and to suggest names, categories, brands, models, and estimated replacement values. AI output is best-effort and is frequently imperfect.

You acknowledge and accept that:

  • AI-identified items may be wrong. The model may misidentify what an item is, who made it, or what it is worth.
  • Estimated values are illustrative, not appraisals.They are based on general retail patterns in the model's training data, not real-time market data, not appraised value, and not actual cash value. They are not an offer to insure, replace, or buy the item.
  • Barcode and UPC lookups can return incorrect product data when manufacturers reuse, retire, or misassign UPCs.
  • Depreciation calculations are formulaic, not specific to your item's condition, age, or local market.

You are responsible for reviewing AI output and editing it for accuracy before relying on it for any purpose — particularly any purpose involving insurance, taxes, legal proceedings, or estate distribution. For high-value items, items that may require a scheduled-articles rider, or items intended as evidence in any formal proceeding, you should obtain an independent appraisal from a licensed appraiser.

We make no warranty as to the accuracy, completeness, or fitness for any particular purpose of AI-generated content.

5. Not insurance advice; not a licensed producer

We are not licensed insurance producers, agents, brokers, public adjusters, or insurance attorneys in any jurisdiction. We do not solicit, negotiate, or sell insurance. We do not adjust claims. We do not receive commissions, kickbacks, or referral fees from any insurance carrier, brokerage, or other intermediary tied to the specific policies you may hold or consider.

The Service surfaces educational information about insurance concepts — how home and renter's policies typically work, what sub-limits commonly apply to certain categories, what scheduled-articles riders are and when they are typically used, how to read a declarations page, what information adjusters typically request, and similar background. This information is general and is not tailored to your specific policy, carrier, state, household, or claim.

The Service also performs math on data you provide. The "coverage gap" calculation compares your documented inventory value against the limits you entered from your declarations page and reports the difference. The "recommended coverage" figure is a starting-point calculation (your documented total plus a typical cushion). The Riders view flags categories that commonly exceed standard policy sub-limits. These calculations are not personalized insurance recommendations, are not based on review of your actual policy language, and are not a substitute for the advice of a licensed professional.

For specific decisions about your insurance coverage, policy choices, carrier selection, rider purchases, claim disputes, denials, or any binding insurance transaction, consult a licensed insurance professional in your state. If you do not have one, your state insurance department maintains a producer license lookup and a consumer assistance line.

If the Service introduces compensated referrals, marketplace participation, or any other carrier-side revenue path in the future, that compensation will be disclosed prominently before you encounter it, and the Service will obtain any required producer licensing or operate through a properly licensed intermediary.

6. Not financial advice; not a financial advisor

We are not financial advisors, investment advisers, registered representatives, broker-dealers, tax preparers, accountants, or fiduciaries of any kind. We are not registered with the SEC, any state securities regulator, FINRA, or any state board of accountancy. We do not provide financial, investment, tax, retirement, or estate-planning advice, and nothing in the Service should be treated as such advice.

In particular:

  • Item values, totals, and aggregates are illustrative, not certified valuations or financial statements. They are not suitable as the sole input to net-worth calculations, tax filings, financial aid applications, divorce proceedings, bankruptcy filings, or any document submitted to a court, regulator, lender, or government agency without independent verification.
  • Depreciation and replacement-cost figures are not tax depreciation and should not be used in tax filings without review by a qualified accountant.
  • The "advisor card" feature, where you save contact information for your insurance agent, financial advisor, estate attorney, or other professionals, is storage of your own contacts. We do not endorse, vet, license, or recommend any specific advisor. Renewal reminders are calendar reminders, not endorsements.
  • The realtor / advisor partner channel (where a partner pays for the marketing surface that shows their contact card in the app of a client they referred) does not change the user's experience of the Service, and the partner does not gain access to the user's data.

For specific decisions about your finances, investments, taxes, retirement, estate plan, or any matter requiring professional judgment, consult a licensed financial advisor, tax professional, or attorney as appropriate.

7. Not legal advice

We are not attorneys, and we do not provide legal advice. The Service can help you organize records that may be useful in legal contexts — beneficiary tagging, photo provenance, audit trails, estate snapshots, claim documentation — but those records are evidence and documentation, not legal instruments. They do not constitute a will, a trust, a power of attorney, a binding beneficiary designation, a court filing, or any other legal document.

Probate, inheritance, estate, and beneficiary law varies by state and country, and small differences in document form can have large legal consequences. Tagging an item to a beneficiary inside Homvi expresses your intent in our system; it does not transfer title, override your will, or bind your executor.

For wills, trusts, beneficiary designations, probate proceedings, estate distribution, real-estate transactions, divorce matters, insurance disputes, or any other legal matter, consult a licensed attorney in the relevant jurisdiction.

8. Acceptable use

You agree not to use the Service to:

  • Catalog property that is not yours, without permission from the owner.
  • Upload illegal content, content depicting minors in any sexual or exploitative context, or content that infringes a third party's rights.
  • Attempt to access another user's data, household, or account.
  • Reverse engineer, decompile, scrape, or interfere with the operation of the Service.
  • Use the Service to defraud a person, an insurance carrier, a court, or any other party — including by inflating values, fabricating items, backdating records, or producing exports intended to mislead.
  • Resell, sublicense, or redistribute the Service or any data obtained from another user through the Service.
  • Use the Service to violate any applicable law, including export-control, sanctions, and privacy laws.

We may remove content that violates this section and may suspend or terminate accounts engaged in any of the above.

9. Privacy: what we collect, why, and who touches it

This section is the Service's privacy policy. It describes what personal information we collect, what we do with it, and the third parties involved in delivering the Service to you.

9.1 What we collect

  • Account information from your sign-in provider: typically your email address and name (currently via Google sign-in through Clerk).
  • Home address(es) that you enter when setting up a home in the app, including property characteristics from public-record lookups for the addresses you enter.
  • Photos that you take or upload through the app, including any metadata embedded in them by your device.
  • Item details you enter or that the AI populates: names, categories, estimated values, descriptions, manufacturer, model, serial numbers, UPCs, purchase dates, original costs, condition, notes.
  • Policy documents you upload (PDFs or images of your insurance declarations pages and policy documents) and the parsed contents of those documents.
  • Household sharing data: the email addresses and identifiers of people you invite to share a home with you.
  • Usage data in aggregate, privacy-friendly form via Vercel Analytics: page views and interaction patterns, with no cookies and no personally identifiable information stored as event properties.
  • Diagnostic and error data via Sentry, including stack traces, request paths, and the minimum context needed to debug a crash.

We do not knowingly collect personal information from children under 13. If you believe we have, contact us and we will remove it promptly.

9.2 How we use it

  • To provide the inventory service to you across your devices.
  • To process photos through an AI vision service for item identification, brand detection, and value estimation (currently Google Gemini).
  • To process policy documents through an AI service to extract structured policy data for your review (currently Google Gemini).
  • To send service-related emails (sign-in confirmations, account notices, household-invite emails). We do not send marketing email without your explicit opt-in.
  • To improve the product based on aggregate, anonymous usage patterns and on diagnostic data from errors.

We do not sell your data. We do not use your data to train AI models. We do not share your data with insurance carriers, realtors, financial advisors, or other third parties except as described below or with your explicit, scoped, revocable consent.

9.3 Vendors and sub-processors

We rely on the following third-party services to operate the Service. Each has its own privacy policy and terms, and we share with each only the minimum data necessary for them to deliver their service.

  • Vercel — hosting, photo storage (Vercel Blob), and analytics.
  • Neon — managed PostgreSQL database for your inventory and account data.
  • Clerk — authentication and account management.
  • Google AI (Gemini) — AI-powered item identification and policy parsing from images and PDFs.
  • Google Maps Platform — address autocomplete for the home setup flow.
  • RentCast — property-record lookup for the home setup flow.
  • Upstash (Redis) — rate limiting on sensitive endpoints.
  • Sentry — error and crash diagnostics.

If we add, change, or remove vendors in a way that materially changes how your data is processed, we will update this section and (for material changes) notify active users.

About AI processing.When you take or upload a photo, the image is sent to Google's Gemini API for item identification. When you upload an insurance policy, the document is sent to the same API for parsing. We currently use the production-tier API where the contract terms prohibit Google from training on inputs and outputs. If at any point we move to a tier with different terms, this section will be updated and active users notified before the change.

9.4 Household sharing

When you invite another person to share a home with you, the invitee receives an email with the invite link, the inviter's name, and the home label. Once the invitee accepts, they can see, add, edit, and remove items in that home. They cannot see other homes you may have, your contact list, or your billing details.

You may revoke a household member's access at any time. Revocation takes effect immediately and removes the member's access to that home's data. Items the member added remain in the home unless you delete them.

9.5 Data retention and deletion

We keep your data until you delete it. When you delete an account:

  • Inventory rows are permanently removed from the database.
  • Photos and uploaded documents are permanently removed from blob storage.
  • Authentication credentials are deleted from Clerk.
  • All deletions are immediate. There is no soft-delete, no recovery period, and no shadow copy left behind.

Encrypted offsite backups, where they exist, are retained for no more than 30 days and then expire. Audit-log entries necessary to detect and investigate abuse (rate-limit triggers, security events) may be retained in aggregated, de-identified form for longer.

9.6 Your rights

You can at any time:

  • Download all your data as a JSON file plus your photos (Account → Data Export). No fee. No friction.
  • Delete your account and have all data wiped (Account → Delete Account).
  • Edit or remove individual items within the app.
  • Revoke household-member access for any home you own.

California residents (CCPA / CPRA).You have the right to know what personal information we collect, to request deletion of your personal information, to correct inaccurate personal information, and to opt out of any "sale" or "sharing" of personal information. We do not sell or share personal information as those terms are defined under California law. Use the Data Export and Delete Account features to exercise your access and deletion rights, or contact us at hello@homvi.ai.

EU/UK residents (GDPR / UK GDPR). You have the right to access, correct, delete, port, and restrict processing of your personal data, and to object to certain processing. Use the in-app tools or contact us. Our lawful basis for processing your data is the performance of this Agreement (the contract you formed by signing up to use the Service).

Other jurisdictions. Where local law gives you additional rights, those rights apply.

9.7 Security

We treat security as table-stakes because the Service holds information about valuable items at specific addresses — a list that, in the wrong hands, is a burglary target.

What we do today:

  • All connections use HTTPS (TLS).
  • Data is encrypted at rest by our hosting providers (Vercel and Neon) using AES-256.
  • Each user's data is isolated at the application layer; no user can see another user's inventory.
  • No employee has routine read access to individual user data. Break-glass access is limited to specific support situations and is logged.
  • Rate limits protect sensitive endpoints from abuse.

What we have committed to for our next major release (v1):

  • Per-user encryption keysso a single database compromise cannot expose any user's contents.
  • Photos encrypted with their own per-user keys.
  • Two-factor authentication required above defined value thresholds.
  • Independent security audit before v1 general availability.
  • Real-wipe account deletion with backup-expiry windows.

No system is perfectly secure. If we become aware of a security incident that affects your personal data, we will notify you in accordance with applicable law.

10. Service availability

We aim to keep the Service running reliably, but we do not guarantee uninterrupted availability. We may perform maintenance, change features, introduce limits, or take parts of the Service offline temporarily. We are not liable for losses caused by downtime, data unavailability, or service changes.

We may also change, suspend, or discontinue the Service or any portion of it. Where a discontinuation removes your ability to access your data, we will provide reasonable advance notice and a data-export window before final shutoff, unless prevented by law or by a security emergency.

11. Pricing, free features, and paid features

The Service currently includes free features (the core inventory flow, photos, AI capture, claim PDF, data export, account deletion) and may include paid features in the future (subscription tiers, marketplace participation, partner-paid surfaces).

We commit that the following will always be free:

  • Capturing your own inventory.
  • Downloading your inventory data and photos.
  • Generating a basic claim-ready PDF.
  • Deleting your account.

We do not run scare-tactic upsells or paywalls inside crisis-mode flows (active claim flows). Auto-renewing subscriptions, if and when introduced, will require explicit consent, will be cancelable at any time, and will not be silently extended.

If we introduce paid features, you will see the price and what is included before you are charged. We do not use hidden fees, surprise charges, or dark-pattern checkout flows.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

NOTHING IN THIS AGREEMENT EXCLUDES, LIMITS, OR MODIFIES ANY WARRANTY OR GUARANTEE IMPLIED BY LAW THAT MAY NOT LAWFULLY BE EXCLUDED, LIMITED, OR MODIFIED.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR PROCUREMENT OF SUBSTITUTE SERVICES — ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

THE ABOVE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY DO NOT APPLY WHERE PROHIBITED BY LAW.

14. Indemnification

You agree to indemnify and hold harmless Homvi LLC, its members, officers, employees, and contractors from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising from (a) your misuse of the Service, (b) your violation of this Agreement, (c) your violation of any law or third-party right, or (d) any content you uploaded or actions you took using the Service.

15. Changes to this Agreement

We may update this Agreement as the product evolves. The "Last updated" date at the top reflects the most recent revision.

For material changes — changes that affect what data we collect, how we use it, who we share it with, or your legal rights — we will give active users at least 30 days' advance notice via email or in-app notice before the change takes effect. For non-material changes (typo fixes, clarifications, vendor list updates that do not change processing), the updated date is the only notice.

Your continued use of the Service after a change takes effect is acceptance of the updated Agreement. If you do not accept the updated Agreement, your remedy is to stop using the Service and, if you wish, delete your account.

16. Governing law and disputes

This Agreement is governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. The parties agree that any dispute arising from or related to this Agreement or the Service will be brought exclusively in the state or federal courts located in the City and County of Denver, Colorado, and each party consents to the personal jurisdiction of those courts.

Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information.

Both addresses are monitored Google Workspace Groups, not single personal inboxes — messages reach the founders directly. We aim to acknowledge privacy and security requests within 5 business days and respond substantively within the windows required by applicable law.
